2. The petitioner has prayed for bail in connection with Mahua P.S. Case No.745 of 2024 registered for the offence punishable under Sections 318(4), 338, 336(3), 340(2), 61(2) & 3(5) of the B.N.S.
3. The case of the prosecution, in short, is that there is ancestral land of the great grandfather of the informant on which they are in possession and rent receipt has been paid up to 2023-2024. It has been alleged that petitioner has executed a forged power of attorney in his name by virtue of the said forged power of attorney, he has created agreement for sale on the basis of the said forged power of attorney to three
Patna High Court CR. MISC. No.12803 of 2026(4) dt.17-04-2026 2/3 different persons. It has also been alleged that the petitioner has created this forged power of attorney with a view to usurp the rights of the informant and his family members.

Learned counsel appearing on behalf of the petitioner has submitted that falsity of the prosecution case would appear that the sale deed was executed on 30.11.1971 and the written report was submitted on 03.08.2024 without explaining the delay of 54 years. Furthermore, the informant along with his family members has already filed a Title Suit No. 1018 of 2024 for declaration of sale deed dated 30.11.1971 and agreement of sale dated 25.07.2024 and 31.07.2024 as forged, fabricated, illegal and void; without seeking relief for declaration of Title and either confirmation of possession or recovery of possession. This shows that it is a pure case of civil dispute between the parties. It has further been submitted that from perusal of the FIR it is clear that the informant is having possession over the disputed property.
It has further been submitted that the petitioner has also filed a Title Suit no. 1894 of 2024 for declaration of Title over the land covered under the sale deed.
Patna High Court CR. MISC. No.12803 of 2026(4) dt.17-04-2026 3/3 court as well. Learned counsel for the petitioner has further submitted that the petitioner is having no criminal antecedent and he is in judicial custody since 03.11.2025.
5. The application for bail is opposed by learned APP for the State and learned APP has submitted that earlier the anticipatory bail of this petitioner was rejected up to Hon'ble Supreme Court.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the court of learned S.J.-V-cum-A.C.J.M.-IV, Vaishali at Hajipur in connection with Mahua P.S. Case No.745 of 2024.
7. Accordingly, the present bail application stands allowed.
