The petitioner seeks bail in a case instituted under Sections 341, 323, 498(A), 376, 511, 504, 506 of the Indian Penal Code and Section 3/4 of Dowry Act.
The prosecution story, in brief, is that the petitioner along with his family members used to torture the informant in various ways due to non-fulfillment of the demand of Alto car. It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.11.2016. Charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses
Patna High Court Cr.Misc. No.9400 of 2017 (2) dt.16-03-2017 2/2 alleged against the petitioner. The petitioner has been made accused due to mistake of fact.
It has jointly been submitted on behalf of the petitioner and the counsel for the Opposite Party No.2 that both the parties are ready to stay together. It is further submitted on behalf of the petitioner that he will keep the Opposite Party No.2 with all respect and dignity.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Siwan in connection with Pachrukhi (M.H. Nagar) P.S. Case No. 148 of 2016.
On the date of furnishing bail bond of the petitioner, the Opposite Party No.2 shall be present in the court below and as per undertaking given by the petitioner, he will be under obligation to take the Opposite Party No.2 along with him with all respect and dignity.
