JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Katihar Town Police Station Case No. 547 of 2014 registered for the offences punishable under Sections 406,420,467,468,471 120B of the Indian Penal Code.

Admittedly, at the time of alleged occurrence, the petitioner was working as Assistant Account Officer in the concerned Bank and furthermore, it is also an admitted position that in-charge of branch manager of the bank has already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court vide order dated 03.03.2015 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.12645 of 2015 (2) dt.21-05-2015 2/2 8169 of 2015. Moreover, the amount was withdrawn by one partner of the concerned firm.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar Town Police Station Case No. 547 of 2014 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
