Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Bodhgaya P.S. Case No. 239 of 2021, registered for offence punishable under sections 147, 148, 149, 341, 323, 353, 333, 337, 338, 427, 504 and 506 of the Indian Penal Code. As per allegation, when the police personnels were pacifying the frenzied mob, the accused persons attacked the police party and some of the police personnel became injured. The learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.12207 of 2022(2) dt.17-09-2022 2/2 that the petitioner is not named in the FIR. His name has been figured on confidential information received by the police. He has submitted further that a case under section 135 of the Electricity Act is pending against the petitioner, in which he is on bail.

Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Bodhgaya P.S. Case No. 239 of 2021, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
