JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sonpur P.S. Case No. 469 of 2016, registered under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a), 38 and 41 of Bihar Excise Prohibition Act, 2016.

The accusation is that in course of checking of the vehicle, a Tata Sumo Gold vehicle bearing Reg. No. JH-01AC8118 was stopped, which was being driven by this petitioner. On search 96.48 liters of India made foreign liquor kept in different bottles were recovered from the said vehicle. Learned counsel for the petitioner submits that petitioner is not the owner of the vehicle in question. Further

Patna High Court Cr.Misc. No.6536 of 2017 (3) dt.22-03-2017 2/2 submission is that, in fact, owner of the vehicle succeeded to flee away and this petitioner was apprehended by the Police mere on suspicion as he is accused in Sonpur P.S. Case No. 361 of 2016. Further submission is that the petitioner is in custody since 23.12.2016 in the present case.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Saran at Chapra in connection with Sonpur P.S. Case No. 469 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
