JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 11-04-2018 Heard learned counsel for the petitioner and Veer Kunwar Singh University (hereinafter referred to as the 'University').

2. In terms of the order dated 27.03.2018, though respondents no. 2, 3 and 4 were directed to appear, only respondents no. 2 and 3 are present. The stand is that the respondent no. 4, pursuant to his transfer has relinquished charge and no fresh incumbent has taken charge.

3. Supplementary counter affidavit has also been filed on behalf of the University in which details of actual payment made to the petitioner has been shown. The fact is not disputed by learned counsel for the petitioner.

4. In view thereof, the writ petition stands disposed off having served its purpose.

5. At this stage, learned counsel for the petitioner submitted that with regard to his claim for promotion to the post of Reader with effect from 22.12.1997, as the matter is a service dispute, he may be permitted to file a fresh writ with regard to such claim.

6. Learned counsel for the University does not oppose.

7. In view thereof, the disposal of the writ petition shall not preclude the petitioner from filing a fresh writ application with regard to the claim for promotion to the post of Reader with effect from 22.12.1997.

8. Personal appearance of the officers stands dispensed with.
