This is an application for bail in connection with Kopa P.S.Case No. 34 of 2016 registered for the offences punishable under Sections 302, 201 and 498A/34 of the Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner is husband of the deceased and during her pregnancy she died and petitioner has no complicity in this case and he is in custody since 29.7.2016.
Heard learned APP also.
Having heard both sides and in view of the fact that dead body of the deceased was found in the house of the petitioner, I am not inclined to grant bail to the petitioner. It appears from the earlier report received from the
Patna High Court Cr.Misc. No.3763 of 2017 (4) dt.06-04-2017 2/2 court below that the case has not yet been committed to the court of sessions and, as such, learned court below is directed to expedite the commitment of the case by separating the case of the petitioner from other accused and thereafter learned trial court is directed to expedite the trial.
With the above observations, this application is dismissed.
