Raghunath Prasad Srivastava v. Manorama Devi And ORS
Patna High Court C.Misc. No.894 of 2016 (2) dt.22-10-2016
IN THE HIGH COURT OF JUDICATURE AT PATNA
CIVIL MISCELLANEOUS JURISDICTION No.894 of 2016 ====================================================== Raghunath Prasad Srivastava .... .... Appellant/s
Versus
Manorama Devi & Ors .... .... Respondent/s ====================================================== Appearance :
For the Appellant/s : Mr. Ranjeet Kumar For the Respondent/s : Mr.
====================================================== CORAM: HONOURABLE MR. JUSTICE MUNGESHWAR SAHOO ORAL ORDER 22-10-2016 Heard learned counsel, Mr. Ranjit Kumar for the petitioner. 2.
Perused the order dated 22.07.2016 passed by the Munsif-1st, Siwan in T.S. No. 99 of 1998.
3.
It appears that during the pendency of the suit, the intervener purchased the entire suit property from the plaintiff. The application was filed under Order 1 Rule 10 C.P.C. and by the impugned order the same has been allowed by the learned Munsif-1st, Siwan.
4.
It is well settled principles of law that the purchasers should be liberally added as party. In the present case, since the entire property has been purchased by the interveners, they have stepped into the shoes of the plaintiffs, therefore, I find no reason to interfere with the impugned order in exercise of supervisory jurisdiction. Thus, this civil miscellaneous application is dismissed.
