The petitioner seeks bail in connection with Muffasil P.S. Case No.981 of 2023 registered for the offence under Sections 302, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is to have committed murder of son of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that specific allegation has not been levelled against that this petitioner rather specific allegation has been levelled against other co-accused

Patna High Court CR. MISC. No. 14937 of 2024(2) dt.22-04-2024 2/2 persons and allegation against this petitioner is only of his presence at the time of occurrence. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 09.10.2023. Similarly situated co-accused has been granted bail by this Court passed in Cr. Misc. No. 5723 of 2024. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner and as no allegation as regard to any overt act has been levelled against this petitioner, let the petitioner, above named, is directed to be released on bail in connection with Muffasil P.S. Case No.981 of 2023 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya.
