JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-02-2016 Petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 323, 324, 307, 302/34 of the Indian Penal Code.
The prosecution case is of killing the daughter of the informant after about ten years of marriage by administering poison by co-accused Jawahar Mahto and the petitioner.
It is submitted by learned counsel for the petitioner that as per the fardbeyan of the informant, it appears that the informant came to know about administering of poison by petitioner and Jawahar Mahto to someone other. The postmortem reflects that the cause of death has not been ascertained and the viscera has been preserved. Though the F.S.L report is not on record. The petitioner happens to be the sister-in-law(Gotni) of the victim.

No.6881 of 2016 (2) dt.15-02-2016 2/2 Considering the suspicious nature of accusation and the petitioner being lady, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran in connection with Marhowrah P.S. Case No. 37 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
