The petitioner apprehends his arrest in Rajpur P.S. Case No. 226 of 2014, registered for the offences punishable under Sections 25(1-b)a, 26 of the Arms Act.

The police raided the house of the petitioner and one 12 bore gun was recovered.

Learned counsel for the petitioner submits that the petitioner was not present at the time of seizure. The seizure list does not bear the signature of any family member of the petitioner. The police is on inimical term with the petitioner that is why the petitioner has falsely been implicated in the case. Considering the facts aforesaid and the fact that one 12 bore gun was recovered from the house of the petitioner although

No.6273 of 2015 (2) dt.16-02-2015 2/2 the petitioner was not present and his wife did not put her signature on the seizure list, but the facts remains that one 12 bore gun without license was recovered from the house of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
