Petitioners, already in custody, seek bail in Piri Bazar P.S. Case No.82 of 2016 registered under Sections 366(A), 34 of the Indian Penal Code.
Allegation in brief is that the 19 years old sister was enticed away by these two petitioners.
Learned counsel appearing on behalf of the petitioners submits that the girl is major and she was having love affair with one Bhola and in her statement recorded under Section 164 of the Cr.P.C., she stated that she went away with Bhola and wants to live with him and earlier she was married with another person but
Patna High Court Cr.Misc. No.11452 of 2017 (2) dt.18-03-2017 2/2 she was not satisfied with the relationship and these petitioners have been in custody since 22.11.2016.
Having considered the said facts and circumstances, the petitioners, namely, Avinash Kumar @ Kaila @ Avnish Kumar and Sheo Kumar @ Shiva @ Shiv Kr. Mandal are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of S.D.J.M., Lakhisarai in connection with Piri Bazar P.S. Case No.82 of 2016.
