The petitioner in this writ petition sought relief for payment of retiral benefits. It appears that the petitioner has already filed several representations, Annexure-2 and 3, before the Chief Executive Officer, Nagar Panchayat, Rafiganj but the representations of the petitioner have not been disposed of. Mr. Manindra Kishore Singh, the learned counsel

Patna High Court CWJC No.4727 of 2019(3) dt.15-06-2020 2/2 appearing on behalf of Nagar Panchayat, Rafiganj submits that the petitioner is not entitled to get retiral benefits according to the Pension Rules of Bihar Municipal Act.

I dispose of this writ petition with a direction to the Chief Executive Officer, Nagar Panchayat, Rafiganj to dispose of the representation of the petitioner within three months and if the petitioner is entitled to get any retiral benefits in accordance with the Rule and the law, the same shall be paid within two months thereafter.

With the aforesaid direction, the writ petition stands disposed of.
