This application for regular bail arises out of Saharsa Sadar P.S. Case No. 551 of 2019, disclosing offences punishable under Section 392 of the Indian Penal Code.

The F.I.R. was registered against unknown with the allegation that the informant's Bolero vehicle bearing registration no. BR-11M-5369, was snatched by the miscreants at the pistol point.

During the course of investigation, one Rajdeep Chaudhary was arrested, who confessed his guilt and disclosed complicity of others including this petitioner. The confessional statement made by Rajdeep Chaudhary, led to the recovery of the stolen vehicle.

No.10325 of 2020(3) dt.29-02-2020 2/2 Learned counsel appearing on behalf of the petitioner has submitted that confessional statement of the co-accused before the police is the only material available against the petitioner and so far he has not been put to T.I. parade. The petitioner is in custody since 16.10.2019.

On perusal of the averments made in paragraph 3 of the application, it can be noticed that the petitioner has criminal antecedent inasmuch as he was implicated in the criminal cases registered in year 2015-2016.

Learned counsel for the petitioner, in this regard, has submitted that the petitioner is on bail in all such cases. Be that as it may, considering the gravity of the offence alleged in the F.I.R. and the fact that the confessional statement of co-accused Rajdeep Chaudhary has resulted into recovery of the stolen motor vehicle, as also the criminal antecedent of the petitioner, I am not inclined to grant the privilege of regular bail to the petitioner.

This application is rejected.
