JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,341,448,323,379 and 504 of the Indian Penal Code. The accusation is of making assault by the petitioner and five others after entering into the house of the informant and snatching cash and ornaments and on protest being made, the informant was assaulted as a result, he sustained fracture injury in leg.

It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general and there is no injury report on record as none has received any injury. It is further submitted that for the occurrence of 8.4.2014 the FIR was

Patna High Court Cr.Misc. No.13241 of 2015 (2) dt.31-03-2015 2/2 registered on 17.4.2014.

Considering the delayed lodging of the FIR and the claim of the petitioner that the informant has not received any injury, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Gaya in connection with Konch P.S. Case No. 60 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. The bail bond of the petitioner will not be accepted if the informant or any other received grievous injury.
