Petitioner is aggrieved by the order dated 5.8.2014 passed by District Magistrate, Gopalganj by which Supply Appeal No. 18/2013 preferred against the order dated 29.6.2013 passed by the Sub Divisional Officer-cum-licensing authority, Hathua by which he has cancelled the licence of the petitioner for running a PDS shop, has been dismissed for want of prosecution.

The petitioner did not even tried to get the appeal restored or re-admitted after the same was dismissed for default. Accordingly, this writ application is being disposed of granting liberty to the petitioner to file an application for restoration /

Patna High Court CWJC No.5385 of 2015 dt.28-06-2016 2/2 readmission of the appeal before the appellate authority. If the same is preferred within 30 days from today then let such application be considered by the appellate authority on its own merit and in accordance with law.
