JUSTICE BIRENDRA KUMAR ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 363/366A/120B of the Indian Penal Code.
Daughter of the informant was found missing from the house. The petitioner is suspected to have induced her to go with him. Later on, the victim was recovered and she supported the allegation that the petitioner forcefully took her and kept in confinement at different places.
Submission of the petitioner is that in fact the matter is of love-affiars and under pressure of the parents the victim has given her statement under Section 164 Cr.P.C. in the
Patna High Court Cr.Misc. No.11261 of 2017 (2) dt.20-03-2017 2/2 manner suggested by the parents. The petitioner is in custody since 03.06.2016.
Considering the material aforesaid and the period already undergone, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. Firoz Akram, learned Judicial Magistrate, 1st Class, Kishanganj/Successor Court, in connection with Thakurganj P.S. Case No. 46 of 2016.
