JUSTICE MADHURESH PRASAD ORAL ORDER 04-04-2019 Learned counsel for the petitioner submits that since criminal prosecution was at the instance of employeer upon acquittal in the same, he would be entitled to benefits of arrears difference of salary for the entire period.
Under office order dated 15.05.2015 and 22.05.2015 Annexures 6 & 7 respectively issued by respondent authorities petitioner has only been allowed notional promotion and therefore under the order of promotion he would not be entitled to any arrears difference.
It is submitted by petitioner's counsel that he will assail the order of notional promotion and assert his right for
Patna High Court CWJC No.2856 of 2016(2) dt.04-04-2019 2/2 regular promotion by way of duly constituted proceeding in accordance with law.
