JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-04-2017 The petitioners seek regular bail in connection with Khiri More P.S. Case No. 3 of 2016, registered for offences punishable under Sections 143, 384, 387 and 435 Indian Penal Code. It has been submitted on behalf of the petitioners that present case is false and concocted one and it appears from the fact that though munsi is the person who informed the informant about the alleged occurrence but the said munsi has not been examined during the course of investigation and also story of extortion is also not supported by any call details and further with respect to the same occurrence earlier also, informant has lodged another FIR, in which, the petitioners have been released on bail. Learned counsel for the State opposed the prayer for bail on the ground that petitioners have criminal antecedents.
Patna High Court Cr.Misc. No.14464 of 2017 (3) dt.10-04-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and also that petitioners have criminal antecedents as they are accused in many other cases, as such, I am not inclined to grant the petitioners the privilege of anticipatory bail, it is accordingly rejected.
However, the trial court is directed to expedite the trial and try to conclude it as early as possible.
