====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

As per audit report, allegation against this petitioner is of defalcating a sum of Rs. 9,73,360/-.

It is submitted that petitioner is ready to deposit Rs. 2,00,000/- (two lacs) in the Court below as first installment at the time of furnishing bail-bond and rest of the amount i.e. Rs. 7,73,360/- (seven lacs seventy-three thousand three hundred sixty) in six equal monthly installments.

Considering the submission of the petitioner, let the

Patna High Court CR. MISC. No.11984 of 2023(3) dt.15-05-2023 2/2 above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P. S. Case No. 522 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further conditions:- (i) At the time of furnishing bail-bond, the petitioner shall refund Rs. 2,00,000/- (two lacs) through demand draft in favour of Ninga PACS.

(ii) Rest amount i.e. Rs. 7,73,360/- (seven lacs seventy-three thousand three hundred sixty) shall be refunded through demand draft in favour of Ninga PACS in six equal monthly installments.

(iii) If the petitioner fails to comply, Court below is at liberty to cancel his bail-bond.
