Mr.Ajay Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 31-08-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406/34 of the Indian Penal Code.

It is alleged against the petitioner that he fled away after collecting money of installment from different customers on behalf of Sphoorty Financial Ltd. It is submitted by learned counsel for the petitioner that petitioner is an employee of the aforesaid financial company. He had collected Rs. 1,06,064/- from

No.11875 of 2022(3) dt.31-08-2022 2/3 49 customers and thereafter deposited Rs. 46,000/- in the Branch and thereafter he deposited Rs. 20,000/- through pay-phone in the Branch office. The petitioner could not deposit rest amount of Rs. 40,000/- due to his illness. The petitioner is still ready to pay rest of the amount to the said financial company.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Madhuban P.S. Case No. 115 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. The bail bonds of the petitioner will be accepted by the learned Court below on showing receipt of deposit of Rs. 40,000/- in favour of Spandana Sphoorty
