The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 302, 120B of the Indian Penal Code and 27 of the Arms Act.
It is alleged that Jagdish Yadav, Brijnandan Yadav, Sidheshwar Yadav, Ram Babu Yadav and Mahesh Yadav came variously armed and made indiscriminate firing, when the informant's father went inside the house, then on the instigation of Jagdish Yadav co-accused Yogendra Yadav @ Lalu Yadav, Sudama Yadav, Nageshwar Yadav and Chanarik Yadav armed with lathi and danda came there and assaulted with iron rod on the head of the father of the informant, when he fell down then co-
Patna High Court Cr.Misc. No.11347 of 2015 (2) dt.19-03-2015 accused Dhanendra Yadav, Sudama Yadav and Brinandan Yadav assaulted with lathi indiscriminately. It is alleged that petitioner and others subsequently damaged the house of the village.
It is submitted by the learned counsel for the petitioner that accusation of assault of father of the informant has not been levelled against the petitioner. Statement has been made in para-2 of the petition that petitioner has no criminal antecedent. Similarly situated co-accused Ram Nihora Yadav @ Ram Nihora Prasad has been granted bail vide Cr. Misc. No. 6782 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Kako P.S. Case No. 189 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
