JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 16-03-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Barh Police Station Case No. 206 of 2015, disclosing offences under Sections 147, 148, 149, 307, 387 of the Indian Penal Code and Section 27 of the Arms Act. The petitioner nos. 1 and 2 are father and son respectively.
From the First Information Report, it appears that allegedly co-accused Bipul Singh and Guddu Singh opened fire, causing injuries to one Sujit.
Learned Counsel for the petitioners submits that they have been falsely implicated because of land dispute and the allegation of demand of rangdari is not only vague, but false and malicious also. He further submits that they
Patna High Court Cr.Misc. No.7547 of 2016 (2) dt.16-03-2016 2/2 have been made accused in other cases subsequent to the institution of the present First Information Report. Considering the submission that there is no specific allegation of any overt act against these petitioners, this application is allowed.
Let the petitioners, namely, Satish Singh and Ravi Kumar @ Ravi Ranjan Kumar, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, Patna, in connection with Barh Police Station Case No. 206 of 2015, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
