This appeal has been filed for setting aside the order dated 7.12.2016 passed by 1st Additional Sessions Judge, Rohtas at Sasaram in a Bail Petition filed by the appellants in connection with Nasriganj P.S.Case No. 202 of 2016 registered for the offences punishable under Sections 147, 148, 323, 325, 307, 504, 506, 379, 354 of the Indian Penal Code and 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and for granting bail to the appellants.

Allegation against the appellants is of raising antiNation slogan and abusing the informant by calling his caste name

Patna High Court CR. APP (SJ) No.367 of 2017 (5) dt.24-05-2017 2/2 and there is general and omnibus allegation of assault against appellant No.1. Further allegation is that appellant No.2 along with other accused persons has assaulted the informant. It has been submitted on behalf of the appellants that appellants have falsely been implicated in this case and the injuries sustained by the informant are simple in nature, which is evident from Annexure-3 and they have remained in custody for seven months.

Having heard both sides and considering the facts and circumstances of the case, let the appellants, named above, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the 1st Additional District & Sessions Judge, Rohtas at Sasaram, in connection with Nasriganj P.S.Case No. 202 of 2016, after setting aside the impugned order dated 7.12.2016.
