2. The petitioner seeks bail, who is in custody since 22.10.2025 in connection with Derni Bazar @ Derni P.S. Case No. 245 of 2025, FIR dated 21.10.2025 registered for the offence under Section 103(1), 61(2), 3(5) of the Bharatiya Nyay Sanhita, 2023 and Sections 27 of Arms Act.
3. According to the prosecution case, due to some dispute, the petitioner fired upon informant's brother due to which he got injured and later taken to hospital for treatment and died during course of treatment.
4. Learned counsel appearing for the petitioner
Patna High Court CR. MISC. No.12018 of 2026(3) dt.03-04-2026 2/2 submits that the petitioner has clean antecedent and he has falsely been implicated in this case and the petitioner is rotting in judicial custody since 22.10.2025.

Learned A.P.P. for the State and learned counsel for the Informant, on the other hand, have vehemently opposed the prayer for bail of the petitioner and submits that petitioner was apprehended and his statement was recorded in paragraph no.11 of the case diary in which he has confessed his guilt and stated that he has fired upon the deceased. He further submits that on the basis of confessional statement of the petitioner, the arms which was used in present crime in question has also been recovered and the same was recorded in paragraph -13 of the case diary.
6. Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Derni Bazar @ Derni P.S. Case No. 245 of 2025 pending in the Court of Judicial Magistrate-1st Class, Saran, Chapra.
7. Prayer is refused.
