Petitioner is accused in connection with Belaganj P.S. Case No. 138 of 2016 registered under Sections 323, 341, 386,435, 379, 34 of the I.P.C., section 14, 16, 17, 18, 20, 38, 40 of the Unlawful Activities Prevention Act and section 17 of the Criminal Law Amendment Act.

Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. Petitioner has not been put on Test Identification as yet. During investigation, witnesses supported the prosecution case however none took the name of this petitioner. Similarly situated co-accused has been granted bail by this Court vide order dated

Patna High Court Cr.Misc. No.10848 of 2017 (2) dt.28-03-2017 10.03.2017 passed in Cr. Misc. No. 7485 of 2017. Petitioner is in custody since 13.05.2016. Other Similarly situated accused persons have also been granted bail by this Court vide different orders passed by this Court.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate III, Gaya in connection with Belaganj P.S. Case No. 138 of 2016.
