The petitioners have filed the present writ application for issuance of a writ in the nature of mandamus commanding and directing to the respondent concerned to remove the encroachment from the entire land of 43 decimal of Mauza Sithoura, Thana No. 448 Khata No. 191, Khesra No. 389 registered in "Survey Khatiyan Gair Mazarua Aam Kism Rasta" on which the several villagers have encroached the aforesaid land in question but the respondent no. 5 issued the notice only

Patna High Court CWJC No.3408 of 2019(2) dt.22-02-2019 2/2 to the petitioners and three others under the pick and choose policy.

The petitioners have filed a complaint/application before the respondent no. 5 in respect of encroachment made on the public land but till date no action has been taken on the part of respondent no. 5.

Considering the relief sought for, the Respondent No. 5 (the Circle Officer, Silaw Circle, District- Nalanda) is directed to pass an appropriate order in accordance with law within a period of four months after giving opportunity of hearing to all the concerned parties.

With the aforesaid observation/direction, the present writ application stands disposed of.
