The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, as a result of the love affair between the son of the informant and the daughter of the petitioner, it is stated that as a result of well planned conspiracy, the petitioner called the son of the informant to her house where he was killed by the other F.I.R. named accused persons. It is submitted by learned counsel for the petitioner that the allegations as levelled in the F.I.R. are false and concocted. The petitioner who is a lady has been falsely implicated in the case. There are no eye witness to the occurrence. For an occurrence alleged to have taken place

Patna High Court CR. MISC. No.22296 of 2021(3) dt.16-11-2021 2/2 on 11.8.2020, there is an unexplained delay of two days in lodging of the F.I.R. The petitioner is in custody since 14.8.2020 and chargesheet has been submitted in the case. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for about 1 year 3 months, the Court directs the petitioner to be enlarged on bail in connection with Kateya P.S. Case no.256 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj.
