JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code, Section 47(a) of the Excise Act and Sections 3, 5 and 18 of the Bihar Excise (Mahua Flower) Rules, 2006.
From a pickup van, 40 bags of Mahua flower were recovered when the driver and cleaner of the pickup van suggested that the same were being carried at the behest of the petitioner. It is submitted by learned counsel for the petitioner that admittedly the recovery has not been made from the petitioner and only on the confession of the driver of the pickup van, the petitioner has been roped in the present case. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.6971 of 2015 (2) dt.12-03-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Tekari P.S. Case No. 235 of 2014 pending in the court of learned JM, 1st Class, Gaya. Accordingly, the application is disposed of.
