The petitioners are apprehending arrest in connection with Jagdishpur P.S. Case No. 320 of 2018 (S.Tr. No. 21 of 2019) for the offence under Sections 302/504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have been summoned under Section 319 of the Cr.P.C. to face trial.

Considering the fact that the court below has summoned the petitioners in exercise of power under Section 319 of the Cr.P.C., the present anticipatory bail application is

Patna High Court CR. MISC. No.10812 of 2020(2) dt.05-03-2020 2/2 disposed of with a direction to the court below (Additional Sessions Judge-VII, Bhojpur at Ara) to grant bail to the petitioners with appropriate sureties to ensure their participation in the pending trial. Their apprehension that they might be arrested, appears to be misconceived, as they have been only summoned at this stage.
