JUSTICE SANJAY PRIYA ORAL ORDER 25-02-2019 Learned counsel for the petitioner is given permission to make necessary correction in para 1 of the bail petition. Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Ballia P.S. Case No. 158/2018, instituted for offences under Section(s) 341, 323, 324, 354, 380, 506, 504 and 34 of the Indian Penal Code. Later on Section 387 of the Indian Penal Code was also added. It is alleged in the written report that petitioner fired shot on the informant, which could not hit him. Thereafter petitioner assaulted the informant with the butt of pistol causing injury on his head.

Injury report is annexed as Annexure-2 which shows that one lacerated injury on occipital region of size

Patna High Court Cr.Misc. No.11074 of 2019(2) dt.25-02-2019 2/2 1.5"x1/4"x1/4" has been found on the person of informant. Opinion is kept reserved.

Petitioner is in custody since 10.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Ballia P.S. Case No. 158/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
