JUSTICE MIHIR KUMAR JHA ORAL ORDER 16-02-2015 After some arguments, learned counsel for the petitioner, having been orally instructed by his client, the petitioner, that he has already filed an appeal on 17.8.2012, seeks permission to withdraw this application in order to enable the petitioner to avail the remedy of appeal.

In view of the fact that no averment has been made in the writ application with regard to filing of such appeal, this Court would not like to say anything in this regard but, then, if the petitioner has filed an appeal, as is being orally claimed by the learned counsel for the petitioner, such an appeal should not be

Patna High Court CWJC No.2715 of 2015 (2) dt.16-02-2015 kept pending for more than two and half years. Therefore, if the petitioner's appeal has been filed and is not disposed of as yet, this Court hopes and believes that the appellate authority will find time to dispose of the appeal expeditiously preferably within a period of three months from the date of receipt/production of a copy of this order.
