The petitioner seeks bail in anticipation of his arrest in connection with Muffasil (Nawada) P.S. Case No. 252 of 2020, dated 15.09.2020, instituted for the offence under Section 135 of the Electricity Act. He is alleged to have committed theft of electrical energy worth Rs. 1,99,000/-.

No.22568 of 2021(2) dt.23-05-2022 2/3 It has been urged on behalf of the petitioner that the accusation is false, but he is ready to deposit fifty percent of the amount upfront though under protest and subject to his rights and contentions later for the purposes of grant of bail.

Subject to the petitioner showing receipt before the learned Court below of depositing an amount of Rs. 1,00,000/- towards the charges of electrical energy with the concerned Department, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Electricity), Magadh Area, Gaya in connection with Muffasil (Nawada) P.S. Case No. 252 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

It is made clear that the aforesaid deposit of Rs. 1,00,000/- before the Electricity Department would
