JUSTICE SANJAY PRIYA ORAL ORDER 23-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Jagdishpur P.S. Case No. 09 of 2017 instituted for the offence under Section-379 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that his name has come in confessional statement of co-accused Karnal Singh which was recorded at paragraph-55 of the C.d. He has clean antecedent. The petitioner is in custody since 25-01-2017. The informant has alleged in the written report that his tractor and tailor was stolen.
The C.D. has been received.
The learned APP has submitted that at paragraph-35 of the C.D., it has come that the tractor has been recovered from
Patna High Court Cr.Misc. No.21156 of 2017 (3) dt.23-06-2017 2/2 possession of Ram Pravesh Yadav. The name of this petitioner has been taken by co-accused Karnal Singh.
In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jagdishpur P.S. Case No. 09 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur subject to condition that both the bailors should be close relatives of the petitioner.
