JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447, 448, 341, 323, 379, 380, 370, 354B, 504B and 506/34 of the Indian Penal Code. The prosecution is that the informant and his wife were sowing wheat on their purchased land on 17.11.2014 when the accused persons came armed with lathi and asked the informant to vacate the land. On protest being made, accused persons assaulted the informant with fists and slaps when co-accused Rashid and the petitioner started pressing the neck of the informant in order to throttle him. Accused persons also pushed down the wife of the informant on the ground and assaulted her with fists and slaps. It is also alleged that the accused persons snatched wrist watch and

Patna High Court Cr.Misc. No.6994 of 2016 (2) dt.16-02-2016 2/2 golden chain from the informant and earring from the wife of the informant and threatened to kill the informant. It is submitted by learned counsel for the petitioners that since the informant is on inimical terms with co-accused Rashik, the petitioner being the relative of Rashid has been roped in the present case when the wife of Rashid filed Jokihat (Mahalgaon) P.S. Case No. 380 of 2014 on 19.11.2014 and thereafter the present case has been lodged. The injury of the informant and his wife has been found to be simple. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 381 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
