====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-05-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offence punishable under section 309(4) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, while the informant was returning to the Branch office of the Company after collecting Rs.2,21,270/-, in the meantime, two unknown miscreants hit him as a result of which he fell down. Thereafter, on the point of arms, both accused persons assaulted the informant and snatched his bag containing aforesaid cash.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused Mundrika Kumar @ Mukesh Kumar.

5. Learned counsel for the State opposes the prayer for bail. He submits that during investigation materials indicating petitioner's involvement in the offence, has been collected. Petitioner has got one criminal antecedent of Excise Act.

6. Considering the nature of allegation and the criminal antecedent of the petitioner, prayer for bail of the petitioner is rejected.
