JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2022 Let the defects, if any be removed within four weeks of the complete start of the physical Court. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barari P.S.Case No. 03 of 2021 registered for the offences punishable under Sections 341, 323, 324, 307, 354A, 379, 504/34 of the Indian Penal Code.

As per prosecution case on 30.12.2020 petitioner along with other co-accused came to the informant ( Akshay Kumar) maize field where Sadhu Mandal assaulted the informant with dabia and when his uncle and mother case to rescue him, other co-accused persons assaulted them. It is submitted that there is a case and counter case

Patna High Court CR. MISC. No.21885 of 2021(2) dt.03-01-2022 2/2 between the parties. From perusal of the injury report of Akshay Kumar shows that two incised wound on his right temporal region and right occipital region which is caused by sharp cutting weapon. The injuries does not show is dangerous to life. Learned APP for the State has opposed the prayer for anticipatory bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioner , in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateV Katihar, in Barari P.S.Case No. 03 of 2021 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) N.K/- U T
