The petitioner apprehends his arrest in Arwal P.S. Case No. 135 of 2016, registered for the offences punishable under Sections 409/34 of the Indian Penal Code. As per the prosecution case, this petitioner along with other FIR named accused persons misappropriated government money of Rs. 13,13,901/-.

It is submitted that at the relevant time petitioner has been falsely implicated in this case. Petitioner has already superannuated from service on 30.06.2009 and after lapse of seven years present FIR has been lodged. Similarly situated coaccused Dinesh Kumar Gupta has been granted bail by this

Patna High Court CR. MISC. No.12664 of 2022(2) dt.16-08-2022 2/2 Court vide order dated 23.08.2018 passed in Cr. Misc. No. 28638 of 2018. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case No. 135 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
