====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-05-2025 Heard learned counsel for the petitioner and the State. Nobody appears for opposite party no.2 in spite of valid service of notice.

2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 363 and 366A of the Indian Penal Code and section 8 of the POCSO Act.

3. As per the prosecution case, all the FIR named accused persons including this petitioner kidnapped 15 years minor daughter of the informant for the purpose of marriage.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that the victim, in her statement recorded under section 164 of the Code of Criminal

Patna High Court CR. MISC. No.11508 of 2025(3) dt.05-05-2025 2/2 Procedure, has stated that she was in love with the petitioner and has solemnized marriage with him in temple in Bettah. Petitioner claims clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, POCSO Act cum Additional Sessions Judge VI, Motihari, East Champaran, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
