In this application for anticipatory bail the petitioner apprehends his arrest for the offence punishable under sections 304 B and 201/34 of the I.P.C.

The daughter of the informant was married with Rajesh Pandey, brother of the petitioner and the informant was informed that the bed of his daughter is burning then he came there and saw that his daughter and Nati are also traceless and accordingly it was alleged that his daughter and Nati have been killed and the dead bodies have been disposed of. Submission is that the petitioner is living separately from the husband of the deceased, to which the learned A.P.P.

Patna High Court Cr.Misc. No.4851 of 2014 (3) dt.22-01-2015 2/2 opposes by submitting that the petitioner has been also living in the same house and the dead bodies of daughter and Nati of the informant has been made traceless.

In the facts and circumstances as stated above, considering the allegation attributed against the petitioner also serious in nature, this Court is not inclined to grant pre-arrest bail to the petitioner. Accordingly, such prayer of the petitioner is rejected in connection with Thakraha P.S. Case No. 25 of 2013 pending in the Court of A.C.J.M. Bagha at West Champaran. However, in case and if so advised, the petitioner surrenders and seeks regular bail then his prayer for regular bail shall be considered on its own merits without being prejudiced by the order of this Court.
