This application under Section 407 of the Code of Criminal Procedure, 1973 has been filed for transfer of the case arising out of Rajgir Mufasil Chhabilapur P.S. Case No. 88 of 2011 pending in the Court of learned Sub Divisional Judicial Magistrate, Biharsharif in Sessions Division, Nalanda to the Court of learned Sub Divisional Judicial Magistrate, Masaaurhi, in Sessions Division Patna or any other appropriate lower Court at Patna.

Learned counsel appearing on behalf of Opposite party No.2 has produced before me a judgment and order, dated

19.08.2016, passed by learned Sub Divisional Magistrate, Biharshariff at Nalanda from which it appears that trial has already concluded.

This application, therefore, has become infructuous and is accordingly, dismissed.

Let copy of the said order dated 19.08.2016 be kept on record.
