Mr.Murli Dhar ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-03-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jainagar P.S. Case No. 426 of 2018 registered for the offence punishable under Section 379 of the Indian Penal Code. The case of the informant is that his motorcycle was stolen by unknown person.

The learned counsel for the petitioner submits that the petitioner has not committed any crime, he is innocent and he has been falsely implicated in the present case. It is further submitted that the petitioner is ready to deposit cash security for the purposes of securing present privilege of regular bail. Lastly, it is submitted that though the petitioner is accused in one other

Patna High Court CR. MISC. No.13172 of 2019(2) dt.26-03-2019 2/2 case but he is on bail in the said case. The petitioner is stated to be languishing in custody since 29.09.2018.

Per contra the learned counsel for the State submits that the petitioner was arrested by the Police along with stolen motorcycle in the company of one co-accused person. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner, above named, on regular bail subject to deposit of Rs. 25,000/- as cash security as also subject to such other conditions as may be imposed by the learned S.D.J.M., Madhubani in connection with Jainagar P.S. Case No. 426 of 2018. It is needless to state that the aforesaid deposit of Rs. 25,000/- with the concerned trial court shall be subject to the final outcome of the trial.

The bail petition stands disposed off with the aforesaid directions.
