This application for regular bail arises out of Barun P.S. Case No. 206 of 2020, disclosing offence punishable under Sections 427/302/34 of the Indian Penal Code and Section 27 of Arms Act.
The wife of the deceased is the informant. Allegedly, the victim had gone with some other persons including one Ashok Singh to attend a Shradh ceremony. While on way, the miscreants, named in the F.I.R., intercepted the deceased and other persons accompanying him and started firing indiscriminately, targetting the deceased. One Ashok Singh is said to have identified the persons making assault, whose names have been mentioned in the FIR. Name of the petitioner does
2/2 not appear in the FIR. Name of one Ram Vijay Singh has been mentioned in the FIR as one of the persons who had also participated in commission of the offence.
Learned counsel for the petitioner states that said Ram Vijay Singh has been granted Anticipatory Bail by this Court by an order dated 22.09.2021 passed in Cr. Misc. No. 14412 of 2021. The petitioner is in custody since 02.11.2020. He has further submitted that the deceased himself was a veteran criminal and it is evident from the FIR that a petty dispute over passage of sewerage, was the reason behind the alleged occurrence.
Considering the facts and circumstances of this case and submissions advances on behalf of the petitioner, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned CJM, Aurangabad in Barun P.S. Case No. 206 of 2020.
