Patna High Court CWJC No.3658 of 2025(2) dt.07-03-2025 2/3 restrained the petitioner to perform his duty on the post of Assistant Teacher as the petitioner was selected vide order dated 07.02.2012 on the post of Regular Assistant Teacher (Trained) 34540 in Pay band P2-(9300-34800) Grade-Pay Rs.
4200/- and latter on wrongly terminated vide letter dated 14.02.2012 and after long litigation, the respondents have reinstated the petitioner in service from the date of his termination vide letter dated 16.05.2024.
B. To issue a direction, order, or writ upon the respondents to grant all subsequent benefit to the petitioner who has been reinstated in the service from the date of his termination on the post of Assistant Teacher (Trained) 34540 grade, as similarly situated persons have already been granted the same benefit in light of judgment rendered in L.P.A. No. 1254 of 2016, and analogous matter, L.P.A. No.
1309 of 2017 and L.P.A No. 1310 of 2017."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no. 3. i.e. The Director, Primary Education, Government of Bihar, Patna for redressal of his aforesaid grievances. Liberty, so
Patna High Court CWJC No.3658 of 2025(2) dt.07-03-2025 3/3 sought, is granted.

It is needless to state that in case the petitioner files appropriate representation for redressal of his aforesaid grievances before the respondent no. 3, within a period of four weeks from today, the respondent no. 3 shall consider the same, in accordance with law and pass a reasoned and a speaking order within a period of six weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
