The petitioner seeks bail in Deo P.S. case No. 17 of 2016 under Section 392 of the Indian Penal Code. Later on Section 395 of the IPC was added.

The petitioner is not named in the FIR. The police apprehended the petitioner and petitioner is said to have confessed his guilt before the police but nothing was recovered from the possession of the petitioner nor the petitioner was put on T.I. parade. Save and except confessional statement of the petitioner, there is no material on record to show the involvement of the petitioner in the alleged dacoity. Co-accused Ajeet Kumar @ Ajeet Kumar Mehta has already been granted bail vide order passed in Cr. Misc. No. 55483 of 2016. The petitioner is in jail

Patna High Court Cr.Misc. No.11675 of 2017 (2) dt.18-03-2017 2/2 since 27.08.2016.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI, Aurangabad in Deo P.S. Case No. 17 of 2016, S. Tr. No. 623 of 2016/ 186 of 2016.
