This application has been filed in connection with Barachatti P.S.Case No.485 of 2016 for the offence under Sections 420, 467, 468, 471, 414 and 120(B) of the Indian Penal Code. The allegation against the petitioners is that they are creating forged documents in order to facilitate to the Truck Driver carrying goods from one place to another place, however, nothing has been recovered from their possession, apart from that one Samsung Mobile and some money have been recovered from them. The petitioners are in custody for about three months and the other co-accused persons, having similar allegation, have
Patna High Court Cr.Misc. No.9590 of 2017 (2) dt.11-04-2017 2/3 already been granted bail by this Court, vide order dated 10.03.2017 passed in Cr. Misc. No.9699 of 2017 and dated 18.03.2017 passed in Cr. Misc. No.13167 of 2017. Heard learned A.P.P. also.
Having heard both sides and in view of submissions, as stated above, and also considering the fact that two other coaccused persons have been granted bail by this Court, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Sherghati at Gaya in connection with Barachatti P.S.Case No.485 of 2016. With following conditions :
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioners shall co-operate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail.
