The petitioners apprehend their arrest in Ahiyapur P.S. Case no. 451/2014, registered for the offences punishable under Sections 366 (A) and other Sections of the Indian Penal Code.
Patna High Court Cr.Misc. No.46023 of 2014 (4) dt.22-06-2015 2/2 The father of the victim made allegation that his minor daughter was kidnapped by the petitioners and others. It is submitted that the informant is not an eye-witness of the occurrence. The victim sent letter to the C.J.M., Muzaffarpur stating that she has solemnized marriage with Raj @ Amit, but the victim has not been recovered as yet. From perusal of the case diary it appears that Manish Kumar Singh is an eyewitness of the occurrence who saw the petitioners and others taking the victim (daughter of the informant) from a Bolero. Considering the facts aforesaid, I am not inclined to enlarge the petitioners above named on anticipatory bail. Accordingly, the same is rejected. If the victim is recovered and make her statement against the petitioners, the petitioners may pray for regular bail.
