The petitioners, who are in custody, seek bail in connection with Sonepur P.S.Case No. 435 of 2016 registered under Sections 272, 273, 420 and 120B of the Indian penal Code and Sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

Allegation in brief is that police recovered 672 cartoons of foreign liquor concealed in a truck parked by the road side and when driver of the said truck was apprehended, he disclosed the names of these petitioners. According to him, the consignment was handed over to these petitioners.

No.6736 of 2017 (2) dt.16-02-2017 2/2 It is submitted that there is no recovery from the possession of the petitioners and they were not present with the truck and except the disclosure of the names of these petitioners by the driver of the truck, there is no other materials to connect him and they have no criminal antecedent.

Having considered the aforementioned facts and circumstances, the petitioners, named above, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Chapra (Saran) in connection with Sonepur P.S.Case No. 435 of 2016 (Arun Kumar, J) Sujit/- U
