The very first paragraph of the present writ petition reads as follows:

"That the present application is for issuance of an appropriate writ/writs, order/orders, direction/directions towards the direction to do Mutation of the property as has been decided in the Judgment of suit no 109/220/1992 of the court of Munsif, Gaya. Shahda Hassan and others v /s The State of Bihar. Marked as annexure 1 to the petition"

Learned counsel for the intervenor Mithu Paswan and others had filed an intervention application and has argued that one Title Suit No. 86 of 2012 has been filed by the intervenor for setting aside the decree passed in Title Suit No. 109/220/1992. In that Title Suit the petitioner and others are defendants and he has relied on order dated 15.02.2017 by which it is apparent that petitioner has appeared in the Title Suit. There is no mention of Title Suit No. 86 of 2012 in the present writ

This writ petition has been filed by suppressing the facts and the petitioner has tried to mislead this Court and obtain order from this Court. This conduct of the petitioner dis-entitles him from any relief from this Court.

This application is dismissed as having been filed by suppressing the fact. The petitioner is being imposed a cost of Rs. 25,000/-. The cost shall be paid to the Legal Aid within four weeks from today failing which the Senior Superintendent of Police, Gaya will take all steps for recovery of the amount of cost from the petitioner.

Let a copy of this order be communicated to the Senior Superintendent of Police, Gaya through FAX and e-Mail for its compliance forthwith.
