2. The petitioner seeks bail in connection with Benibad P.S. Case No. 83 of 2024 registered for the offence under Sections 64, 62, 3(5) of Bhartiya Nyay Sanhita, 2023 and under Section 8 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping a minor victim girl along with one Ram Sagar Singh and confined her in illegal custody and have also committed rape upon her.

4. It has been argued by the learned counsel for the petitioner that the accused Ram Sagar Singh has been granted

Patna High Court CR. MISC. No.11363 of 2025(2) dt.07-03-2025 2/2 bail and his case is similar to the petitioner's case.

5. Learned counsel for the petitioner also submits that there is delay of 3 days in lodging the FIR and the petitioner is in custody since 2.11.2024.

6. Learned counsel for the State has opposed the prayer of the petitioner for grant of bail.

7. I have considered the submissions of the parties.

8. The ground of grant of bail to Ram Sagar Singh is that he is 80 years old and it is not possible for a person of that age to commit rape.

9. In view of the above discussions, this Court is not inclined to grant bail to the petitioner.
